Limited Warranty Policy

Temple Street Equipment®

1. Introduction

This Limited Warranty Policy (this “Warranty”) sets forth the limited warranty offered by AHP for products sold under the Temple Street Equipment® and Temple Street™ brands (collectively, the “Products”). This Warranty is a limited warranty under the Magnuson-Moss Warranty Act, 15 U.S.C. § 2301 et seq., and is not a “full” warranty.

By purchasing, registering, or submitting a claim under this Warranty, you acknowledge that you have read, understood, and agreed to the terms below.

2. Definitions

  • “Authorized Channels” means (a) temple-street.com, and (b) the Temple Street Equipment® storefront on Amazon.com operated by AHP.
  • “Original Purchaser” means the individual end-user consumer who first purchased the Product through an Authorized Channel for personal, non-commercial use.
  • “Useful Life” means the period during which a Product, or a specific component thereof, is reasonably expected to perform its intended function under normal consumer use, as determined by AHP in its sole and reasonable discretion.
  • “Wear Parts” means components of a Product that are subject to gradual wear during normal use and are listed as wear parts on temple-street.com, including but not limited to foot caps, shock cords, fabric panels, foam pads, mesh inserts, and similar items.
  • “Manufacturing Defect” means a defect in materials or workmanship existing at the time of manufacture and not arising from use, wear, accident, misuse, or any cause excluded under Section 5.

3. Who is Covered

This Warranty extends only to the Original Purchaser and is non-transferable. Products purchased from any source other than an Authorized Channel — including but not limited to unauthorized resellers, third-party marketplaces (other than the Temple Street Equipment® Amazon storefront operated by AHP), auction sites, and used or refurbished sellers — are not covered.

This Warranty applies only to Products purchased and used by U.S. residents in the United States. International customers are addressed in Section 10.

4. What is Covered (Limited Lifetime Coverage)

Subject to the exclusions in Section 5, AHP warrants that:

(a) Core Components. The primary structural components of the Product (such as the main frame, hubs, and primary load-bearing assemblies) are warranted against Manufacturing Defects for the Useful Life of the Product, as determined in accordance with Section 2.

(b) Non-Core Components. Fabric, mesh, stitching, hardware finishes, and similar non-structural components are warranted against Manufacturing Defects for two (2) years from the date of original purchase.

(c) Wear Parts. Wear Parts are not covered under this Warranty. See Section 6.

(d) Discontinued Products and Components. If a Product or component is discontinued and AHP no longer has the capability to repair or replace it, AHP may, in its sole discretion, satisfy any obligation under this Warranty by issuing store credit redeemable at temple-street.com.

This Warranty does not entitle the Original Purchaser to a cash refund.

5. What is Not Covered

This Warranty does not cover, and AHP shall have no obligation with respect to, any of the following:

(a) Normal Wear and Tear, including but not limited to:

  • Fabric fading, color change, or pilling;
  • Surface scratches, scuffs, abrasions, or cosmetic blemishes;
  • Wear or stretching of shock cords or bungee cords;
  • Wear of foot caps, end caps, or contact points;
  • Compression, flattening, or softening of foam pads or cushions;
  • Stitching wear at high-stress points consistent with normal use;
  • Zipper wear from regular operation;
  • Oxidation, patina, or surface finish change on aluminum, steel, or other metal components.

(b) Damage from Use, including:

  • Drops, impacts, crushing, or other mechanical damage;
  • Use beyond the Product’s stated weight or load capacity;
  • Use for purposes other than those for which the Product was designed;
  • Failure to follow care, use, or assembly instructions provided with the Product;
  • Modifications, alterations, or repairs not authorized in writing by AHP;
  • Use of non-genuine replacement parts or accessories.

(c) Environmental and External Causes, including:

  • Prolonged exposure to ultraviolet (UV) light, sunlight, or extreme temperatures;
  • Exposure to salt water, salt air, chlorine, or other corrosive substances;
  • Mold, mildew, fungus, or biological growth resulting from improper storage;
  • Damage caused by animals, insects, or pests;
  • Acts of nature, including but not limited to wind, fire, flood, lightning, and earthquakes;
  • Theft, loss, or vandalism.

(d) Commercial, Rental, or Institutional Use. This Warranty applies only to personal, non-commercial use. Use in rental fleets, equipment rental businesses, campgrounds, hospitality operations, military, government, educational, or other commercial or institutional settings voids this Warranty.

(e) Improper Care, Cleaning, or Storage, including damage from improper laundering, use of harsh chemicals, or storage in damp or contaminated conditions.

(f) Cosmetic Issues that do not affect the function of the Product.

(g) Products Without Valid Proof of Purchase, as required under Section 9.

6. Wear Parts Program

Wear Parts are not warranted but may be purchased from AHP as replacement parts.

  • Wear Parts are available for purchase at the prices listed on temple-street.com, which prices may change at any time without notice.
  • Wear Part availability is subject to inventory and may be discontinued at AHP’s sole discretion.
  • Shipping, taxes, and handling charges apply.
  • Purchase of Wear Parts does not constitute a warranty claim and does not extend, modify, or restart the warranty period for the Product.

The current list of designated Wear Parts is published at temple-street.com and may be updated by AHP from time to time.

7. Remedies

If AHP determines, in its sole and reasonable discretion, that a Product has a Manufacturing Defect covered by this Warranty, AHP’s sole obligation, and the Original Purchaser’s exclusive remedy, shall be — at AHP’s sole election — one of the following:

  • (a) Repair of the defective Product or component;
  • (b) Replacement with the same or, if unavailable, a functionally comparable Product or component (which may be new or factory-refurbished); or
  • (c) Issuance of store credit redeemable at temple-street.com in an amount not to exceed the original purchase price actually paid by the Original Purchaser for the affected Product.

No cash refunds will be issued under this Warranty. AHP’s maximum aggregate liability under this Warranty shall not exceed the original purchase price actually paid by the Original Purchaser for the affected Product.

8. Claim Procedure

To submit a warranty claim, the Original Purchaser must:

Step 1 — Submit a Claim.

Submit a claim through one of the following channels:

  • Online form: temple-street.com/warranty
  • Email: warranty@temple-street.com

Step 2 — Provide Required Information.

  • Full name, email, shipping address, and phone number;
  • Order number (Amazon order number or temple-street.com order number);
  • Product model and date of purchase;
  • A description of the alleged defect;
  • Clear photographs and, where appropriate, video of the alleged defect.

Step 3 — Await RMA.

AHP will review the claim and, if eligible, issue a Return Merchandise Authorization (“RMA”) number and instructions. Items returned without a valid RMA will not be accepted, processed, or returned, and AHP shall have no liability for such items.

Step 4 — Ship the Product.

Ship the Product, prepaid and adequately insured, to the address provided with the RMA. Risk of loss in transit to AHP rests with the Original Purchaser.

Step 5 — Resolution.

AHP will use commercially reasonable efforts to resolve eligible claims within thirty (30) business days of receipt of the returned Product. AHP will pay return shipping for any repaired or replaced Product within the United States.

AHP reserves the right to refuse, modify, or cancel any claim that is fraudulent, abusive, or not in compliance with this Warranty.

9. Proof of Purchase

Valid proof of purchase from an Authorized Channel is required for any warranty claim. Acceptable proof includes:

  • A copy of the order confirmation email from temple-street.com;
  • A copy of the Amazon order detail page showing AHP / Temple Street Equipment® as the seller;
  • A receipt or invoice clearly showing the Product, date, and Authorized Channel.

Warranty registration on temple-street.com is encouraged but not required. Registration may expedite claim processing.

10. International Customers

This Warranty is offered primarily to U.S. residents. AHP may, in its sole discretion, honor warranty claims from customers located outside the United States, subject to the following:

(a) AHP ships repaired, replaced, or warranty-related items only to addresses within the United States. International customers must provide a U.S. shipping address (e.g., a freight forwarder or designated U.S. recipient) for any warranty fulfillment.

(b) The Original Purchaser is solely responsible for all costs associated with international warranty claims, including but not limited to: international outbound and return shipping, customs duties, import taxes, value-added tax (VAT), brokerage fees, and shipping insurance.

(c) AHP is not responsible for items lost, damaged, delayed, or seized by customs authorities during international transit.

(d) AHP does not ship to, and will not honor warranty claims from, jurisdictions subject to U.S. economic sanctions or export controls administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) or other applicable authority.

(e) Where mandatory consumer protection laws of the customer’s country of residence (such as the EU Consumer Sales and Guarantees Directive or equivalent) provide rights that cannot be waived by contract, those mandatory rights remain available to the customer against the seller of record in that jurisdiction. In all other respects, this Warranty governs.

11. Disclaimer of Implied Warranties

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

12. Limitation of Liability

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

13. Governing Law

This Warranty shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

(a) Informal Resolution. Before filing any formal claim, the Original Purchaser and AHP agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to this Warranty or the Products (a “Dispute”) informally for at least thirty (30) days. Such informal resolution begins upon written notice from one party to the other. Notice to AHP must be sent to warranty@temple-street.com.

(b) Binding Arbitration. If a Dispute is not resolved within thirty (30) days under Section 14(a), the Dispute shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except as modified by this Warranty. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Wilmington, Delaware, provided that, at the Original Purchaser’s election, telephonic or video hearings shall be available for claims of USD 25,000 or less.

(c) Class Action Waiver. The Original Purchaser and AHP each agree that any Dispute shall be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator shall have no authority to consolidate claims or to preside over any form of class or representative proceeding.

(d) Exceptions. Notwithstanding the foregoing, either party may (i) bring an individual action in small claims court for Disputes within that court’s jurisdiction, and (ii) seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

(e) Governing Arbitration Law. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

(f) Severability of Class Action Waiver. If the Class Action Waiver in Section 14(c) is found unenforceable as to any Dispute, then the entirety of Section 14 (other than this clause) shall be null and void as to that Dispute, and the Dispute shall proceed in court.

15. Arbitration Opt-Out

The Original Purchaser may opt out of the arbitration provisions in Section 14 by sending written notice of opt-out to AHP within thirty (30) days of the date of original purchase. Notice must be sent to:

warranty@temple-street.com

with the subject line “Arbitration Opt-Out” and must include the Original Purchaser’s full name, mailing address, order number, and a clear statement that the Original Purchaser wishes to opt out of arbitration. Opt-out is effective only upon timely receipt by AHP.

Opting out of arbitration does not affect any other provision of this Warranty, including the warranty coverage itself. An Original Purchaser who timely opts out retains the right to pursue Disputes in a court of competent jurisdiction in the State of Delaware.

16. Severability; Entire Agreement

If any provision of this Warranty is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

This Warranty constitutes the entire agreement between the Original Purchaser and AHP with respect to the warranty of the Products and supersedes all prior or contemporaneous oral or written communications, proposals, and representations regarding warranty coverage. No employee, agent, dealer, or representative of AHP is authorized to make any modification, extension, or addition to this Warranty.

17. Changes to This Warranty

AHP reserves the right to modify this Warranty at any time. Any modifications will apply to Products purchased on or after the effective date of the modification. The version of this Warranty in effect at the time of original purchase shall govern claims related to that Product.
